Michigan Dept of Agri Forces Farmer to Dump 248 Gallons of Organic Milk and Break 1200 Free Range Eggs

While Americans in the nearby city of Detroit face life in third world conditions, unable to even afford running water,  the state of Michigan decided to direct its resources towards cracking down on a small food co-op in Standish for having the utter audacity to provide milk, butter, cream and eggs to people who bought shares in the organic dairy.

The Michigan Department of Agriculture must be so proud of their deeds, after they forced Joe and Brenda Golimbieski, the owners of  Hill High Dairy and Jenny Samuelson, the owner of My Family Co-op, to dump out 248 gallons of milk, to break 100 dozen eggs, and to destroy an undisclosed amount of fresh cream, butter and cheese.

According to a post on the Hill High Dairy page on Facebook, the agents from the MDA stood over the family, watching as the food was destroyed.

100 dozen eggs… Each egg had to be broken. 248 gallons dumped in a sprayer that had to be witnessed by MDA being dumped and sprayed on the field.

According to the owners of the dairy, the MDA threatened to arrest the co-op owner, Jenny Samuelson,  for “selling food without a license.” However, the farm is a co-op, where people must buy shares. The MDA, however, said that the co-op contracts were invalid, and therefore, instead of being shared, the food was being sold. Because co-op members had paid for their shares, technically the MDA stole food that belonged not just to the Golimbieski family, but to every single member of that co-op.

One member wrote angrily:

This is such a shame! I paid for these products and this is what happened!!!! They are all criminals!!! Government stealing all our food! I paid just so that Jenny and the farmers didn’t have to carry the burden all on their own!!!! A crying shame. Shame on Michigans Department of Agriculture! Criminals everyone on u!!!!

Looking at the website and Facebook page, all I see are happy, well-treated animals, actually roaming around in fields.  How is it that Michigan approves of the horrific conditions in its state’s factory farms, where animals are tortured, drugged, and crammed into cages for the entirety of their miserable lives, but raising animals humanely and naturally is considered “dangerous”?

What is wrong with the world when REAL farming is treated like a crime and fresh food is treated like the crystal meth?

I’ll tell you what’s wrong – big corporations do not want us to have options. They want a monopoly and they are working hard to destroy our other choices. Big Agri clearly has many good friends in the Michigan Department of Agriculture. Clearly the “Department of Agriculture” really means the “Department of Big Agri”. They aren’t there to support small farmers or people who wish to be self-sufficient. They are there to lock down the market for corporate farms. (Like Dean Foods, who also owns Horizon Organics – read more about the way this company does business – they own up to 90% of the corporate milk business in the state, according to an article on The Complete Patient )

David Gumpert, a raw milk advocate and owner of the site The Complete Patient wrote:

The government-sponsored dump of nearly $5,000 of milk, eggs, butter, and cream from Michigan’s My Family Co-Op yesterday carried a very clear and powerful political message to all Americans: We control your food and we don’t like you buying your food outside the corporate food system. Every now and then, we are going to remind you of what bad children you are being by taking your food and throwing it in the garbage. In fact, we are going to do more than remind you, we are going to completely humiliate you by preventing you from even feeding it to farm animals and instead forcing it to be disposed of in a landfill or dumpster…

…If you think I am exaggerating the intent of what is going on here, ask yourself this question: When was the last time you saw government agents seize and condemn food from a place like Foster Farms or Taco Bell or Del Monte or Kellogg’s or Trade Joe’s when their food has been found to contain pathogens, or made people sick? The state of Michigan appears in the news again and again for infringing upon the liberty of its residents to choose what they wish to consume. Recently, they took away the “right to farm” from ordinary people, rescinding a law that had been on the books for years. Before that, Michigan’s Department of Natural Resources destroyed a farmer’s heritage pigs, calling them an “invasive species.”

This horrible visual of a farmer destroying fresh food while an “agent” stands over him to make certain that it’s inedible will stick with me. It’s like a scene from a movie, where the vanquishing enemy goes “scorched earth” on the denizens of the area they have conquered, ruining their crops, stealing their food stores, and most of all, making certain that they know they’ve been defeated.

Except it’s not a movie. It’s life in America. The barbarians are members of the government, and it is our own farms that are under siege.

  • As a young chap who delivered ‘real’ milk seven days a week to families in the suburbs of Brisbane Queenland Australia
    in the mid to late fifties, and all from hand milked dairy cattle, this news made me very very angry!
    America has lost it in more ways than one but this news item just tops the lot!

    • Same evil scum of government in Australia. When the Cyclone Yasi happened in Far North Queensland Australia 2011, a local dairy farmer wanted to give away a few thousand liters of fresh, raw milk to the affected people. The government stopped him because it wasn’t pasteurized and he was forced to dump it.

    The ‘Beast’ today is government and much like when the antichrist appears, everyone shall be required to accept the ‘mark of the Beast’ to buy and sell goods. These small farmers and their co-op members tried to be independent.

    The world has never witnessed the wide spread evil that exists today. I have no idea if tribulation is near. But dark days are coming. If you have not yet taken action to protect your love ones, what are you waiting for?

  • I’ve experienced two destruction instructions during my life up close. In hindsight several patterns emerge.

    1. There’s always some Single Specific person who’s logic stands on borderline Oath breaking criminality, this person authorizes and drives the show.

    2. The actual destruction has no logic at all whatsoever, there could actually be someone in need really close nearby, if you can get away with not destroying part, go with that.

    3. Get the ordeal over with fast. These guys suck to be around, you want them gone, when they are gone they can’t damage anything. Next they will want to put down your chickens, cows, pigs, etc.

    Until you figure out who these players are and put a NAME on it and destroy this person and their crappy Operating Procedures, things will just get worse. Fast-track this asshole through the meat grinder!

    And blood will boil, perhaps violence, if cops, economy, monetary system get much worse. Eventually your going to have to defend your right to LIVE here.

    • If I am not mistaken, Michigan *did* have pig farmers of heritage pigs kill them all. I also understand that small farms that raise animals may longer be able to do it unless the property is far enough away (I don’t know the details of distance) from a house.

      • The right to farm wasn’t taken away. They did make it more difficult for somebody to start a brand new farm on a small property in a residential zone if the city/township ordinances would prohibit it, which is unfortunate, but Right to Farm still stands. Also, it only ever protected commercial farming, not farming for personal use. I am currently fighting Emmett Township over zoning laws for my small farm in Battle Creek. (I own 1.4 acres and rent an adjoining 67 acres, and between the two properties I am actually following the township’s law anyway, but they didn’t bother to ask me before slapping me with a lawsuit saying I’m not permitted to have animals on less than 5 acres.) The good news about the law change is that if you were already in business, it does not affect you, only new operations.

    • From a friend: Why didn’t they produce their license if they were processing food? Why didn’t they just sell everything off the farm property? If organics is just a set of regulations agreed upon by the usda and farmers why are they picking and choosing which regulations to follow? If they were certified organic then they agreed to the contract of rules in exchange for a usda organic sticker and all the benefits that come with it. Organics requires extensive records to be kept in order to verify certification. Not for some scheme against small farms, but for food safety concerns. Yes factory farms are atrocious disease filled dens. That is not a reasonable argument to turn a blind eye to every “organic” farm. That is saying its not ok for some large factory operation to poison a bunch of people but these small farms don’t do as much volume so its ok for them to do it. Organic producers ride the wave of the idea that their product is a better option in turn they must take the steps to prove that fact not hide behind the shield of public opinion.

  • It is prudent to make plans for guerrilla sufficiency. You will not be able to publish any self-sustaining effort in the open. In the near future, you will not be able to grow a garden in the traditional method. You will have to resort to small hidden patches or bucket gardening that can be moved at a moment’s notice.   • It’s interesting that a customer implicates the farm in the very article intended to support it: “This is such a shame! I paid for these products and this is what happened!!!!”

    That’s precisely the point the article says the MDARD inspectors were attempting to make— that people were paying for the products and were not true shareholders. Whoops.

    The article sure packs in a lot of emotion and rhetoric to make us think it’s something other than it is. But what if I were doing a poor job of producing food that was ridden with pathogens and sold it to you without a license? Would you then hope that MDARD would come in and require that I follow the law? Would you want them to wait until someone got sick or would you want them to enforce the law for me and everyone else all the time? If someone breaks a traffic law, but is a really, really nice person who does good work for charity, should they be excused from following the law?

      No, I don’t believe food requires a license. In fact, I’m not much of a believer in the other laws you cite. Most of what you THINK is there for your safety is there for control and revenue generation. And when we buy shares, we DO own the dividends of those – i.e., the food.

    • If you are doing a poor job and producing food that is ridden with pathogens and selling it then you will shoot yourself in the foot. People will not buy from you unless you are selling a quality product. You will go out of business in a hurry and we wouldn’t need the MDARD to do anything about you because you won’t be selling anything to anyone. The rules and regs are for Big Ag because they produce tainted food and want there to be an illusion of safety in their products.

    • Being a shareholder requires payment. Shares are not free. A shareholder pays for ones share, thus pays for whatever one takes from the co-op. Did the shareholder pay plan meet Michigan law? Did the MDARD inspectors verify the shareholder membership, and were they legally correct in visiting the shareholder farm without an appointment and without a court order? What evidence can you present to verify that the co-op was not complying with Michigan law ?

If organic co-ops such as this were half as dangerous as you imply, then the VERY BEST means of regulating and protecting the public would be the propaganda factor. The state operates on the ‘ends justify the means’ principle; It therefore follows if they had the best interests of the public at heart then they would have allowed this for the very same reason I would.     • I lived in South America for many years and people would go door to door every morning selling fresh cows milk, eggs, cheese & yogurt. In 7 years I never heard of anyone getting sick and if they tried to sell old milk, they simply went out of business from word of mouth. Pathetic, weak-minded people need the government to watch over them like a nanny. Sue this fits you to a tee.

  • See if “The Young Turks” You Tube channel will do a feature on this sickening bit of infamy. Get all the lawyers you can and sue the lot of them. Yes, Big Agribiz and government officials are in a collusion against competition. Dean Foods may have a Pilgrims Society member on its board (history’s most dangerous Secret Society!) Find out the names of the top bosses in the MDA, look them up in Who’s Who in America, see if they have had involvement with the Rockefeller Foundation or other Pilgrims Society entity.

  • Daisy – don’t these farmers have memberships with the Farm to Consumer Legal Defense Fund? We had a similar circumstance happen in Nevada at a Farm to Fork dinner at a CSA. They contacted FTCLDF, who represented them and the represent a lot of these big government abuse cases. There was so much uproar from all over the world about this particular incident, the farmers became activists and legislation ended up being passed in Nevada to protect farmers from this kind of nonsense. We need to spread this message far and wide so that MDA gets so much flack that they will not dare to try this again

    • According to their website, they do have a membership in the Farm to Consumer Legal Defense Fund. It will be very interesting to see what happens with this case. I sincerely hope they pursue it.

Donations should be made publicly and send a copy to the Michigan Department of Agriculture. Their supporters in Michigan as well as their co-op owners (those who own shares) should be writing stories for their local papers showing the donations and support and bringing publicity to this issue.

  • The key here is that yes, they’re giving food stamps and free water to the people of Detroit because that makes those people completely dependent upon the government, but when people are self-sufficient and can stay alive by their own means, that’s when our government goes after us.

  • This incident is very confusing. I can see them dumping the milk because it was not pasturized but why the eggs. Is there some law in the usa about free range eggs being harmful. In Canada we have a quota system that you buy your quota but there is still a lower amount , I believe it is 100 chicken that you don’t need quota for. We have free range egg stands in many areas. Around here many people buy their eggs from farms with a few hens and there is no problem. Can anyone tell me why they couldn’t “sell” or “dividend” the eggs.

  • This reminds me of a recent situation in Michigan where a person had this anti food government attitude and kept producing unpasteurized cider in disgustingly dirty conditions. Several people got very ill including a 12 year old boy who will be sick the rest of his life. One lady almost died. Reminds me of a Face Book posting I just saw. “When you’re dead, you don’t know it. It’s like being stupid.”

  • People are cows in a pen. That’s where the farmer (any Government)wants them. People are stupid and lazy. It doesn’t take much effort to have a couple chickens in a box in the backyard to have your own eggs. It doesn’t take much to have a little greenhouse in the backyard to grow your own food. Learn to be just a little self sufficient. If you learn to grow a little food and learn to cook and eat real food then they have that much less of a choke hold on you. But that takes effort and we Americans aren’t use to putting much effort to better ourselves. Now if you want to be better than them big farmers then you have do what they do and go buy a couple of politicians like they have. If you own a couple of them like Big AG. does then you get to make the rules. IT IS THAT SIMPLE. Gather some money, organize behind one of your own and get into the politics of your state.   • It is really amazing. I was born in Communist China and I can tell you that even in Communist China, they don’t do this kind of sh*t. Let’s face it, people in the United States are living in a Totalitarian Police State the likes of which the world has never seen or experienced before.

  • Organic farmers should check out becoming members of Organic Valley Coop based out of Wisconsin, or similar coops if any exist. Organic Valley is trying to achieve at the coop level what Big Food is at the corporate level. So far they are doing pretty well.

    Another option is to form a coop under a regional CSA for organic and other small local producers through which to market, license and protect their products from fascist technocrats serving their Big Food masters.

  • Our government and larger corporations are so tightly knit on so many levels that it is difficult to figure out where to start the fight of separating the 2.

    However, right now, we need to band together, get our own smart lawyers (random check for soul in contract)and make these co-ops unbreakable under the law. That way, the robots(people that say “I’m just doing my job” with no moral limits because they are in fear of becoming unemployed) can’t be sent in to smash all the good food. It’s a simple way for the corp/gov combo to force us to pay for groceries the way they want us to.

    Always remember, judge people, businesses and the government on actions, not words. The words are always diversionary. Let’s keep fighting…..no giving up…

    Greens MP and Environment Spokesperson Dr Mehreen Faruqi said:

    “My condolences go out to the man’s family. This tragic incident underlines the very real risks that environment workers can face when enforcing the law.

    “My understanding is that that there are long running legal cases around illegal land clearing in the Croppa Creek area. There must be safety protocols for environment workers who have to deal with potentially volatile situations and strong safeguards to prevent such an incident from ever happening again,” Dr Faruqi said.

  • I am reading a lot of great comments, but looks like no one is standing up and doing anything, no one is making the first move. Michigan-Throw up your arms and fight against your politician. Stand up for your rights, and give the government what they deserve. A Revolution. Christian or not, we are American and we have the rights to this land just like anyone else in the government. Last time I check no one on this earth is God. A mutiny needs to begin and not on the internet but on foot.

  • This is a great example of “regulatory capture”. Our government regulatory agencies, which originally served the greater public good, have been “captured” by national and multinational corporations. Many of these regulatory agencies are now run by former industry executives. They look out for the industry first, and public health is a secondary effect.

    Let’s be clear: there are good reasons to strictly regulate the sale of raw milk. Prior to this regulation, thousands of people died every year from improperly stored raw milk. But as long as people understand the risks of raw milk and how to handle it, they should have the right to purchase such raw milk. It makes sense to make raw milk more difficult to buy, but not to make it impossible to buy!

    The danger here isn’t limited sales of raw milk, it is competition from small organic farmers.

  • The people of Michigan need to march on their state capital over this, this is wrong and it needs to be addressed by the good people that live in the state, it is only then that things will change. The people must say No in a clear unified voice. If they don’t they will lose their freedom. Letters, emails and faxes as well as in person appointments with their state and federal representatives are in order. As well as coordinated marches like the 1960’s. It is of note that their are large neighborhoods of elderly retired peoples in Michigan who have the time and energy at this stage of their lives to be involved with stopping this atrocity and helping the younger members of the state understand through teaching why this is wrong. Please people take the initiative to lead the way. Need I say the time is now!

  • The key here is a failure to obtain a license. Certain types of agricultural businesses require licenses and inspections on a regular basis… in ANY STATE. Not researching the legalities involved is the farmer’s fault. It has nothing to do with big ag versus little ag in this case.

    I’m as against factory farms all the way, but if you’re not going to get properly licensed, something like this is bound to happen. Especially when you’re turning over this kind of volume, which makes it really hard to fly under the radar.

    Note to the author – where do you get ‘the feds’ out of a state department of agriculture? Clearly, you don’t understand the difference between federal and state regulation. Nor do you have much knowledge about business licensing, which having been an agricultural business owner in Michigan, I can factually state all of the above. Both My Co-Op and High Hill Dairy are not properly licensed or none of this would have happened. It’s quite likely that they were not caught by surprise either.

  • THE REAL TRUTH >>>>>>>>>> The problem isn’t the State people… Jenny is not allowed to sell raw milk unless she is the owner of the cows– SHE DOESN”T OWN THE COWS!!! Because of her, this all happened!!! THIS IS THE TRUTH, had the farm complied with the State Law this would not have happened… the farm knew they were selling her milk and was warned numerous times to stop,because she doesn’t own the cows, but they ignored the warnings!!! I don’t agree with the dumb laws either, which is why we should take back our country!!!

  • Oh Michigan you need to learn how we do it in Kansas City. People who want raw milk or products straight from the farmer buy it secretly under the table. Don’t publicly advertise your product. Spread info by word of mouth. Trust me if people want it they will find it.

  • Im so tired of not being able to live as I choose. I too grew up drinking milk straight from the cow bucket on to the cereal before school. If I could afford it I would buy a very large piece of land, fence it well. Australia is supposed to be the “lucky country” and America is supposed to be the land of the free. I send my sympathy.
